عبر الجامعة الوطنية للتعليم FNE المغرب [من النقابات التعليمية الأكثر تمثيلية بقطاع التربية الوطنية وقطاع التعليم العالي في المغرب، وعضو اتحاد النقابات العالمي (WFTU-FSM) والاتحاد الدولي للنقابات التعليمي (FISE) ] تتبعنا تمريركم لمشروع قانون الإطار 51-17 للتربية والتكوين، فى البرلمان، الذي صادق عليه من قبل مجلسيه خلال العطلة الصيفية (22 يوليوز و2 أغسطس 2019)؛
ونحن في الاتحاد الدولي للنقابات التعليمية (FISE) (العضو في اتحاد النقابات العالمي (WFTU-FSM) الذي يمثل أكثر من 97 مليون عامل وعاملة بالتعليم في جميع أنحاء العالم) تابعنا عملية إنجاز قانون الإطار 51-17 للتربية والتكوين في المغرب، الذي يُقنِّن الرؤية الاستراتيجية 2015-2030.
ويهدد قانون الإطار حق الشعب المغربي في تعليم عمومي مجاني وموحد وجيد، من التعليم الأولي إلى التعليم العالي (الخوصصة، التمويل، الشراكات، اللغات، البرامج، …)، عن طريق فتح قطاع التعليم لرأس المال الأجنبي والمحلي للاستثمار في هذا القطاع الحيوي.
إن خوصصة التعليم تتناقض كليا مع مبادئ “المساواة والإنصاف وتكافؤ الفرص وعدم التمييز”؛ وهي تهدف وتسعى فقط إلى الربح المالي، وفقًا للمنطق الرأسمالي المهيمن على المستوى العالمي. مما لا شك فيه أن رأس المال هذا يؤدي إلى إعادة هيكلة الوظائف التعليمية وتدهور دورها الاجتماعي والاقتصادي.
وفي هذه المناسبة، نود أن نعرب لكم عن بالغ قلقنا إزاء السرعة العالية لعملية خوصصة التعليم في المغرب، من مرحلة التعليم الأولي إلى التعليم العالي، وخاصة منذ سنة 2000، باسم “الشراكات عام – خاص”.
بالإضافة إلى ذلك، سيدمر قانون الإطار ما تبقى من مجانية التعليم في المغرب باسم “الشراكات مع المجتمع المدني والأسر …”، وبهدف “تنويع مصادر تمويل التعليم”؛
وعلاوة على ذلك، نذكركم أن قانون الإطار لم يأخذ في الاعتبار الأوضاع المأساوية والعمل غير اللائق للعاملين في مجال التعليم كحالة المربيين والمربيات بالتعليم الأولي أو ظروف العاملين في خدمات الحراسة والتنظيف… وتجدر الإشارة أيضًا إلى الوضع المأساوي للمُدرِّسِين / المُستخدَمِين “المُتعاقِدين” (عددهم 70000 أفواج: 2016، 2017، 2018، 2019)، دون أن ننسى بالطبع، وضع الفئات المختلفة لنساء ورجال التعليم بالمغرب.

Subject: Framework Law 51-17 of Education and Formation in Morocco
Mr. the head of the government,
The National Federation of Education (FNE Morocco), is among the most representative unions within the national education and higher education sectors. Also, FNE is a member of the World Federation of Trade Union WFTU-FSM. It is a member of the World Federation of Educational Trade Unions (FISE) as well. We were informed that you have passed the frame work project law number 51-17 during the summer break (22 July and 2 August 2019);
The World Federation of Educational Trade Unions, which is a member of The World Federation Trade Union (WFTU-FSM), represents more than 97 million workers worldwide, all of them work in the educational sector. FISE, has closely followed the elaboration process of the frame work law bill of education and formation in Morocco, the law authenticates the strategic vision of 2015-2030.
The framework law violates the fundamental right of Moroccan children to access to a public, free, and effective education, starting from before the primary education up to higher education (privatization, financing, partnerships, languages, programs,). The point where the educational sector becomes a target of both local and international capitals.
The privatization holds the state accountable for for contradicting both the constitution and the international conventions which aims at protecting equity, justice and unified education and against discrimination. Privatization targets financial profitability in essence. In fact this orientation is dictated by the dominant international capitals.
The shift undoubtedly will reconstruct the function of education and schooling to serve the purpose of the dominant capitals, which will affect negatively the socio economic role of education.
On this occasion, we would like to express our deep concern at the high speed of the privatization of education in Morocco, in all its levels beginning from pre-school to higher education. A governmental process which was set first in 2000 taking the form of “Public-Private Partnerships; “PPP”.
More interestingly, such a framework law in the educational sector will ultimately annhilate the right to free education in Morocco; namely when it encompasses the “agreements with civil society and families …”, or rather “partnerships with civil society, families …”, all of them are but procedures set for the sake of “diversifying sources of school funding”.
Importantly, we remind you that this framework law has not taken into account the precarious and deplorable situations of the improper work of education workers, such as preschool educators, or the conditions of employees in the security and cleaning services. Also noteworthy is the catastrophic situation of the 70000 “contracors” teachers and the deplorable conditions in which they perform their duties, (“contractors” recruited in 2016, 2017, 2018, 2019), without forgetting, of course, the situations of the different categories of human resources in the educational field.

Objet: La loi-cadre 51-17 de l’éducation et de la formation au Maroc
Monsieur le Chef du Gouvernement,
La Fédération Nationale de l’Enseignement FNE-Maroc (l’un des syndicats les plus représentatifs du secteur de l’éducation nationale et du secteur l’enseignement supérieur au Maroc, membre de la Fédération Syndicale Mondiale (FSM) et de la Fédération Internationale des Syndicats de l’Enseignement (FISE)), nous a informé que vous avez passé le projet de la loi-cadre 51-17 de l’éducation et de la formation, au Parlement, qui l’a ratifié par ses deux chambres durant les vacances d’été (les 22 juillet et 2 août 2019);
La Fédération Internationale des Syndicats de l’Enseignement (FISE) (membre de la Fédération Syndicale Mondiale (FSM) représentant plus de 97 millions travailleuses et travailleurs de l’enseignement dans le monde) a suivi le processus d’élaboration de cette loi-cadre 51-17, de l’éducation et de la formation au Maroc, qui authentifie la vision stratégique 2015-2030.
Cette loi-cadre met en cause le droit des enfants marocains à un enseignement public, gratuit, unifié et de qualité, du préscolaire au supérieur (privatisation; financement; partenariat; langues; programmes, etc.), et ce, en ouvrant encore le secteur de l’enseignement aux capitaux étrangers et locaux pour investir dans ce secteur vital.
Ces privatisations de l’enseignement remettent en question les principes de l’équité, de la justice et de l’unité puisqu’elles ne visent que la rentabilité financière, la recherche des profits conformément à la logique capitaliste dominante au niveau mondial. Cet acharnement du capital conduit, sans doute, à la restructuration des fonctions de l’enseignement et à la dégradation de son rôle social et économique.
A cette occasion, nous tenons à vous exprimer notre grande inquiétude à l’égard de la grande vitesse du processus de la privatisation de l’enseignement au Maroc, du préscolaire au supérieur, surtout depuis l’an 2000, au nom des «partenariats public privé ppp».
De surplus, cette loi-cadre détruira ce qui reste de la gratuité de l’enseignement au Maroc au nom des «partenariats avec la société civile et les familles…», ayant pour motif «la diversification des sources de financement de l’éducation»;
Par ailleurs, nous vous rappelons que cette loi cadre n’a pas apporté de solutions aux vrais problèmes et les situations précaires et déplorables du travail indécent des travailleurs de l’enseignement privé et public tels que les éducateurs du préscolaire et les conditions des travailleurs des services de gardiennage et du nettoyage. A noter aussi la situation catastrophique des enseignants «employés»/ «contractuels» et les conditions dans lesquelles ils exercent leur fonction (au nombre de 70000: promotions 2016, 2017, 2018, 2019) sans oublier, bien sûr, la situation des différentes catégories des travailleurs de l’enseignement.

Asunto: la ley marco 51-17 de la educación y de la formación en Marruecos
Señor Jefe de Gobierno,
La Federación Nacional de la Enseñanza FNE-Marruecos (uno de los sindicatos más representativos del sector de la educación nacional y del sector de la enseñanza superior en Marruecos, miembro de la Federación Sindical Mundial (FSM) y de la Federación Internacional de Sindicatos de la Enseñanza (FISE)), nos ha informado de que ha presentado al Parlamento el proyecto de ley marco 51-17 sobre educación y formación, y que este ha sido ratificado por sus dos cámaras durante las vacaciones de verano (22 de julio y 2 de agosto de 2019).
La Federación Internacional de Sindicatos de la Enseñanza (FISE) (miembro de la Federación Sindical Mundial (FSM), que representa a más de 97 millones de trabajadoras y trabajadores de la enseñanza en todo el mundo) ha seguido el proceso de redacción de esta ley marco 51-17 sobre la educación y la formación en Marruecos, que autentifica la visión estratégica 2015-2030.
Esta ley marco compromete el derecho del pueblo marroquí a una enseñanza pública, gratuita, unificada y de calidad, desde la enseñanza preescolar hasta la superior (privatización, financiación, asociación, lenguas, programas, etc.), abriendo aún más el sector de la educación al capital extranjero y local para que invierta en este sector vital.
Estas privatizaciones de la enseñanza ponen en tela de juicio los principios de equidad, justicia y unidad, ya que apuntan únicamente a la rentabilidad financiera, a la búsqueda de ganancias de acuerdo con la lógica capitalista dominante a nivel mundial. Este ensañamiento del capital conduce sin duda a la reestructuración de las funciones de la enseñanza y al deterioro de su papel social y económico.
Por este motivo, nos gustaría expresar nuestra gran preocupación por la gran velocidad con que se está privatizando la educación en Marruecos, desde la enseñanza preescolar hasta la superior, especialmente desde el año 2000, en nombre de las “concertaciones público-privadas”.
Además, esta ley marco destruirá lo que queda de enseñanza gratuita en Marruecos en nombre de “concertaciones con la sociedad civil y las familias…”, con el objetivo de “diversificar las fuentes de financiación de la educación”;
Además, le recordamos que esta ley marco no ha tenido en cuenta las situaciones precarias y deplorables del trabajo indecoroso de los trabajadores de la enseñanza, como son los educadores de preescolar, ni las condiciones de los trabajadores de los servicios de seguridad y limpieza. Cabe destacar también la catastrófica situación de los 70.000 docentes “empleados”/ “contratados” y las condiciones en las que desempeñan sus funciones, que componen las promociones de 2016, 2017, 2018, 2019, sin olvidar, por supuesto, la situación de las distintas categorías de trabajadores de la enseñanza.
